In the event you wish to purchase any of these services or products, you will be asked by Sponsor or an authorized third party on Sponsor’s behalf to supply certain personal information, including without limitation, your full name, address, telephone number and credit card information. You agree to provide Sponsor or such third party with accurate, complete and current information always, and to comply with the terms and conditions of this Agreement. Prices may vary. You are responsible for obtaining access to the Service and that access may involve third party fees (such as Home Health Care and Internet service provider or travel charges). You are responsible for those fees, including those fees associated with the display of delivery of advertisements. In addition, you must provide and are responsible for all special equipment necessary to access the Service. You shall be responsible for all charges incurred through your account as well as for paying any shipping and handling charges, and applicable taxes.
2.2 Services. Payment authorization agreement client acknowledges the Company Services are not covered by insurer including Medicare and that the plan fee is not reimbursable by client’s insurer, including Medicare and other Health Plan. Client agree to bear the financial responsibility for the plan fee and any applicable additional servicesfee, and agrees not to submitto client’s insurer, including Medicare or any other healthcare plan, any bill, invoice or claim for payment or reimbursement ofthe plan fee and any applicable additional services fee.
2.3 Payment. We accept the following credit cards: Visa; MasterCard, Discover and American Express. We also accept check cards from Visa and MasterCard. Our secure server encrypts all credit card information you enter. Occasionally, a request for credit card authorization fails before the card is finally authorized.
2.4 Appointment Cancellation Policy. Please be ready for your medical consultation or therapy appointment on time to ensure a full consultation or therapy session. Any delay on your side may compromise the delivery of the service and may be subject to an extra fee charge up to an extra hour of service with no exception. You may cancel your appointment without charge up to 24 hours preceding your appointment. Same day cancellations will be charged 50% of the scheduled service price. If you do not call to cancel your appointment or do not show up for your scheduled appointment, you will be charged full price for the scheduled appointment.
2.5 Refund Policy. All sales are final and services packages are non-refundable, with no exceptions. However, all services are 100% Guaranteed RISK-FREE
3. MEDICAL CONSULTATION
Client designates Lucidelix Ketamine-Assisted Therapy healthcare provider, as client functional, infusion medical consultant. This service, in no way is meant to take place of your medical doctor or primary care. This service is intended to improve overall health and wellness and does not cover emergencies. Each client understands and acknowledges that Lucidelix Ketamine-Assisted Therapy healthcare providers and staff will do their best effort to be available for the date and time of the appointment for your consultation. The term “healthcare provider” as used throughout the Agreement hereto, covers Marc Rodriguez ARNP, ARNP, and other designated licensed medical professionals.
5. INDEMNITY
You shall indemnify and hold harmless Sponsor from and against any and all claims, damages, liabilities, injuries, losses or expenses, including attorneys’ fees and expenses of counsel and the collection thereof, that may be incurred by or asserted or awarded against Sponsor, arising out of or in connection with or by reason of, or in connection with the preparation for a defense of, any investigation, litigation or proceeding arising out of, related to or in connection with your use of our Website, your connection to our Website, your purchase of products or services from this Website, your breach of this Agreement, or your violation of any law or the rights of a third party.
6. THIRD PARTIES
Your participation, correspondence or business dealings with any third party found on or through the Website, regarding payment and delivery of specific goods, and any other terms, conditions, representations or warranties associated with such dealings, are solely between you and such third party. You agree that Sponsor shall not be responsible or liable for any loss, damage, or other matters of any sort incurred as the result of such dealings.
7. PRIVACY
Sponsor views the protection of your privacy as a very important responsibility. The terms regulating the handling of personally identifiable information and other information provided by you in connection with the Website is described in our Privacy Policy
8. RISK OF LOSS
All items purchased from the Website are shipped pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery to the carrier.

Sponsor attempts to be as accurate as possible. However, Sponsor does not warrant that the service or product descriptions or other content of this site are accurate, complete, reliable, current, or error-free.
10. E-MAIL & TEXT MESSAGING COMMUNICATION
You should be aware that email and text messagingare not a secure medium for sending and receiving potentially sensitive personal health information. Communication between the client and the practice via email or text messaging shall be governed by the Practice’s then-current Health Insurance Portability and Accountability (“HIPAA”) privacy policies and procedures. Although Lucidelix Ketamine-Assisted Therapy and affiliated companies will take steps to keep your communication with their physician, staff, employees and representatives, confidential and secure, the confidentiality of email communication cannot be assured or guaranteed.
11. NO AGENCY
No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created between you and Sponsor by this Agreement.
12. GOVERNING LAW
You acknowledge and agree that this Agreement shall be governed by and construed in accordance with the laws of the State of Florida, excluding conflict of laws provisions thereof that would indicate the application of the laws of any other jurisdiction and you hereby submit to exclusive jurisdiction in the federal and state courts of Florida.
